Refund & Cancellation Policy – SafetyDice.com

Consolidated for Directive 2011/83/EU of the European Parliament and of the Council on consumer rights (CRD).

1.1 Definitions

As laid down in its Article 1, the CRD applies to ‘contracts concluded between consumers and traders’. Therefore, for a contract to be covered by the Directive, it is necessary to establish that one party thereto is a trader, as defined in Article 2(2), and the other party a consumer, as defined in Article 2(1).

According to Article 2(1), ‘consumer’ is any natural person who, in contracts covered by the Directive, is acting for purposes which are outside his/her trade, business, craft or profession. It follows from that provision that two cumulative conditions must be satisfied in order for a person to fall within the scope of that concept, namely that:

  1. the person is a natural person, and
  2. the persons acts for non-professional purposes.

Trader’ is defined in Article 2(2) as a natural or legal person acting ‘for purposes relating to his trade, business, craft or profession’ or in the name or on behalf of a trader. Not only privately owned, but also publicly owned persons can be qualified as a trader.

‘Point of Sale’ the point of sale for contracts between Sheva Inc Ltd via its online shop www.safetydice.com and its customers is the Republic of Cyprus.

‘Value Added Tax’ refers to the applicable tax rate for goods and services subject to VAT in the Republic of Cyprus, which is currently at 19%.

Sales Contract’ means any contract under which the trader transfers or undertakes to transfer ownership of goods to the consumer, including any contract having as its object both goods and services.

distance contract’ means any contract concluded between the trader and the consumer under an organised distance sales or service-provision scheme without the simultaneous physical presence of the trader and the consumer, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded’

2.1 Purchases via www.safetydice.com

With a completed purchase of goods under the brand „Safety Dice“ from Sheva Inc Ltd via its online shop under the domain www.safetydice.com by placing an order using the „Buy“ button at the electronic checkout and by receiving the order confirmation by electronic mail correspondence accordingly, a customer enters into a valid sales contract for physical goods at the point of sale, wheres the customer fills the role of the consumer and Sheva Inc Ltd fills the role of the Trader.

2.2 Non-Off-Premises contracts

Online B2C )business to customer) sales are not conducted with both, the Trader and the Consumer being present in the same premises locations. Trader and Consumer enter into a distance contract.

2.3 Restrictions

Sheva Inc Ltd delivers goods sold to its Consumers to such Consumers located in Member States of the European Union (EU) only.

2.3 Article 5(3) of Directive 2011/83/EU

Sheva Inc Ltd as a Trader fulfills its obligations of pre-sale information in a commonly comprehensible language towards the Consumer. By electronic means, the information remains easily accessible and readable.

3.1 Right of Withdrawal (Cancellation Right)

As a consumer residing in the EU, you have the legal right to withdraw from your purchase within 14 days without giving any reason.

Withdrawal Period:

The withdrawal period will expire 14 days from the day:

You as a consumer or a third party (other than the carrier) receives the product, or in the case of multiple items ordered in one order and delivered separately: when the last item is delivered.

3.2 How to Exercise Your Right to Cancel

To cancel your purchase, please notify us of your decision clearly and in writing. You may use the model withdrawal form below, but it is not mandatory.

You must send your cancellation notice before the 14-day withdrawal period expires.

4.1 Returns & Refunds

If you withdraw from your purchase, you must return the product to us within 14 days of notifying us.

4.2 Return Conditions:

The product must be returned in its original condition, including all components and packaging.

You as a Consumer are responsible for the direct cost of returning the goods.

Sheva Inc Ltd as a Trader will issue a refund using the same payment method used for the original transaction.

4.3 Refund Timing:

We will reimburse you within 14 days of receiving the returned item(s), or proof of return (whichever is earlier).

5.1 Exceptions to the Right of Withdrawal

You cannot cancel or return:

– Products that have been customized or personalized.

– Products that are sealed for hygiene or safety reasons and have been unsealed after delivery (e.g. items with embedded electronics where packaging seal was broken).

6.1 Defective or Damaged Items

If your Safety Dice arrives damaged or defective, please contact us within 7 days of receipt with a photo and description. We will offer a replacement or full refund, including return shipping costs.
